ONLINE Workshop NEC4 and NEC4 Alliance Contract

This online workshop is organized by ie-net and ICE Belgium and Luxembourg & Maverick Enterprise.

The NEC contracts have a long history but are not as well known yet in continental Europe. The first modern NEC contract – then known as the 'New Engineering Contract' – was published in 1993. It was a radical departure from existing building and engineering contracts, being written in plain language and designed to stimulate rather than frustrate good management. The second edition, called the NEC Engineering and Construction Contract (ECC), appeared two years later. A decade of extensive international use followed, culminating in the development and launch of the NEC3 contract suite in 2005. The NEC3 suite has been endorsed by governments and industry worldwide and has an unrivalled track record for delivering projects on time and on budget – including the London 2012 Olympic and Paralympic Games venues. Twelve years on and with several hundred billion pounds more procurement under its belt, the contract suite’s next evolution NEC4 contract suite – was launched in 2017. In an ever more open, collaborative and fast-paced society the NEC4 contracts are more relevant than ever and as an engineering professional or mediator you cannot afford to remain in the dark on them.

The first and second session would deal with an introduction to the NEC4 Contracts. 


The NEC4 Suite of Contracts builds upon the success of the NEC3 Contracts. The proven and unique processes for collaboration, fair dealing and good project management that are inherent in the NEC philosophy remain in this evolved edition. The NEC Contracts have been updated and streamlined following feedback from the industry, considering Government priorities and emerging best practice. The result is a contract suite with improved flexibility, clarity and which is easier to use whether one is supplying high-value goods or low-risk items. This part of the workshop focusses on introducing users to the NEC4 family of contracts. Delegates will thus gain an understanding of the philosophy of NEC; the extent of the NEC family and how it extends to goods, works and services procurement. There will also be an outline of a few key features of the NEC Contract. Delegates will get to see how NEC produces a diverse range of definitive end-to-end project management contracts that empower users to deliver projects on time, on budget, and to the highest standards. They will also gain insights in the unique flexible nature of the NEC4 glowing it to be used for the procurement of works, services and goods across all sectors – including public and private, buildings and infrastructure, plant and equipment – as well as all stages of a project lifecycle, from planning, design and project management to construction, maintenance and facilities management.
 

The last session would deal specifically with the NEC4 Alliance Contract. 

Alliancing is an exciting procurement direction for many clients, particularly when considering a highly complex project with an emerging scope. The potential benefit of using this contract includes a much deeper collaboration between all project partners, bound by common interests and reducing the potential for dispute. This contract is different from the others within the NEC4 suite as it is a multi-party contract with an integrated risk and reward model. However, it largely follows the same principles of other NEC4 contracts, with familiar provisions, management processes and terminology.

The NEC4 Alliance Contract (ALC) marks the next step in NEC collaboration, creating a ‘true’ alliance arrangement in which the client and all key members of the supply chain, called ‘Partners’ in the ALC, are engaged under a single contract. All members of the alliance have an equal voice and share in the performance of the alliance as whole as opposed to their own individual performance.

About the speaker

Robert Gerrard, Secretary NEC Users' Group, UK
His main interest is helping people produce brilliant tender documents for the construction industry and then perform exemplary contract management, using NEC3 and NEC4 contracts.
Outside of construction, he is also an Accredited Mediator practicing in the area of civil and commercial mediation.

Language

All documentation will be made available in English. The spoken language will be English, but native bilingual speaker familiar with the subjects will be at hand to assist.

Target Group

The workshop is intended for engineers of consulting and engineering firms, contractors, building managers, commercial mediators, etc....
